TERMS AND CONDITIONS OF ENTRY

General

1. Promoter

The promoter is Julark Pty Ltd (ABN 47 112 966 248), trading as Fishing Addiction Australia ("Promoter").

The Promoter's address is Unit 1/54–60 Industry Drive, Tweed Heads South NSW 2486 ("Promoter's Premises").

2. Promotion

These Terms and Conditions apply to the Fishing Addiction Carbine Boat Giveaway ("Promotion").

Information regarding the Promotion and the Prize forms part of these Terms and Conditions. Participation in the Promotion is deemed acceptance of these Terms and Conditions.

To the extent of any inconsistency between these Terms and Conditions and any other communication or advertisement relating to the Promotion, these Terms and Conditions prevail.

3. Regulatory approvals

The Promotion will be conducted in accordance with all applicable Commonwealth, State and Territory laws.

Who Can Enter

4. Eligibility

Subject to these Terms and Conditions, entry is open to Australian residents aged 18 years or over who hold a current, active and fully paid Fishing Addiction membership ("Eligible Members").

5. Fishing Addiction Membership

Fishing Addiction is a subscription membership club. Members pay the applicable membership subscription fee and receive membership products and benefits, including an annual Fishing Addiction member pack with a retail value of more than $200.

Fishing Addiction members also receive access to additional membership benefits which may include exclusive member content, fishing experiences, promotions and prize giveaways.

The Fishing Addiction Carbine Boat Giveaway is an additional benefit offered to Fishing Addiction members.

No additional entry fee or charge is payable to participate in this Promotion beyond the ordinary cost of Fishing Addiction membership.

The price of Fishing Addiction membership has not been increased for the purpose of conducting this Promotion.

6. Ineligible persons

Employees of the Promoter, the Prize Supplier, associated agencies and companies, and contractors directly involved in the conduct of the Promotion, and their immediate families, are not eligible to enter.

For the purposes of this clause, "immediate family" means a spouse, ex-spouse, de facto spouse, child or stepchild, parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin.

 

 

How to Enter

7. Automatic Member Entry

Each Eligible Member will automatically receive one (1) entry into the Promotion.

No separate purchase, competition entry form or additional payment is required.

Entry into the Promotion is an additional benefit of Fishing Addiction membership and is not separately purchased.

8. Eligibility at Close of Promotion

To be included in the Prize draw, an Eligible Member must hold a current, active and fully paid Fishing Addiction membership at 11:59 AM AEDT on 12 November 2026.

A membership that has been cancelled, refunded, charged back or is otherwise not financial at the close of the Promotional Period will not be eligible for entry.

Each Eligible Member is entitled to one (1) entry only, regardless of the length of their membership or the number of membership payments made during the Promotional Period.

All valid entries have an equal chance of being drawn.

9. Member Details

Eligible Members are responsible for ensuring that the name, telephone number, email address and other relevant details associated with their Fishing Addiction membership are accurate and current.

The Promoter reserves the right to verify an entrant's membership status and eligibility before conducting the draw or awarding the Prize.

 

 

Promotional Period, Draw and Winner Announcement

10. Promotional Period

The Promotion commences at 12:01 PM AEDT on 28 September 2026 and closes at 11:59 AM AEDT on 12 November 2026 ("Promotional Period").

All eligibility requirements must be satisfied by the end of the Promotional Period.

11. Prize Draw

The Prize draw will take place at the Promoter's Premises at Unit 1/54–60 Industry Drive, Tweed Heads South NSW 2486 at 2:00 PM AEDT on Thursday, 12 November 2026.

The Winner will be the first valid Eligible Member randomly drawn.

The Promoter will ensure that all valid entries included in the draw have an equal chance of winning.

If a draw is required to occur on a public holiday at the location of the Promoter, the draw may be conducted on the next business day, subject to applicable State and Territory legislation.

12. Winner Notification and Publication

The Winner will be contacted by telephone and email within two (2) business days of the draw using the contact details associated with their Fishing Addiction membership.

The Winner's name will also be announced through Fishing Addiction's official channels, including the Fishing Addiction website and the Promoter's official Facebook and Instagram pages, on 12 November 2026.

The Winner's name will remain published for any minimum period required under applicable State or Territory legislation.

13. Unclaimed Prize

The Promoter will make reasonable attempts to contact the Winner using the contact information associated with their Fishing Addiction membership.

If the Prize remains unclaimed, or if the person originally drawn is found to be ineligible or unable to satisfy these Terms and Conditions, the Promoter may conduct an unclaimed prize draw, subject to applicable State and Territory legislation and any required regulatory approval.

Any unclaimed prize draw will be conducted at the Promoter's Premises on:

The winner of any unclaimed prize draw will be contacted by telephone and/or email within two (2) business days and their name will be published as required by applicable law.

 

 

Prize

14. Number of Winners

There will be one (1) Winner of the Promotion.

15. Prize

The Winner will receive one customised boat package comprising:

  • one 4.85m Carbine 485 Cape Yorker with centre console and steering;

  • one heavy-duty single-axle galvanised braked trailer

  • one Mercury 60 hp FourStroke Command Thrust outboard motor (75 hp maximum);

  • 1,200 mm forward casting deck with integrated insulated esky;

  • rear casting deck;

  • Lowrance Elite sounder;

  • Lowrance Recon electric motor; and

  • custom branding on the hull.

The Prize is supplied by Port Douglas Marine Engineering ("Prize Supplier").

16. Prize Value

The total Prize is valued at up to AUD $70,000 including GST, as at 28 September 2026.

The Prize value is based on the value of the Prize at the time these Terms and Conditions are published. The Promoter accepts no responsibility for any variation in the value of the Prize after that date.

17. Registration, Insurance and Ongoing Costs

Unless expressly stated otherwise, the Prize does not include:

  • boat registration;

  • trailer registration;

  • insurance;

  • ongoing maintenance;

  • fuel;

  • storage; or

  • any other ongoing ownership or operating costs.

These costs are the responsibility of the Winner.

18. Prize Conditions

The Prize is not redeemable for cash and, except where required by law, is not transferable or exchangeable.

The Prize must be taken as awarded.

19. Warranty

Any applicable new boat, motor, trailer or equipment manufacturer's warranties will apply in accordance with the relevant manufacturer's terms and conditions.

20. Delivery or Collection

The Promoter and Winner will arrange delivery or collection of the Prize following confirmation of the Winner.

Delivery/collection arrangements and responsibility for transport costs will be at the discretion of the Promoter. The Winner will be responsible for any registration, insurance or other costs associated with taking ownership of and using the Prize unless expressly agreed otherwise by the Promoter.

 

 

Verification and Prize Claim

21. Verification of Winner

Before awarding the Prize, the Promoter may require the Winner to provide reasonable proof of:

(a) identity;

(b) age;

(c) Australian residency;

(d) current and financial Fishing Addiction membership;

(e) eligibility under these Terms and Conditions; and

(f) any other information reasonably necessary to verify the Winner's entitlement to the Prize.

The Winner may also be required to sign reasonable Prize acceptance, release, registration, transfer or handover documentation, subject to applicable law.

22. Invalid Entries and Conduct

The Promoter reserves the right, subject to applicable law, to invalidate an entry or disqualify an entrant who:

(a) provides false, misleading or fraudulent information;

(b) creates or uses duplicate or fraudulent memberships for the purpose of obtaining additional entries;

(c) attempts to manipulate the Promotion, membership records or entry process;

(d) interferes with the fair or proper conduct of the Promotion;

(e) does not satisfy the eligibility requirements set out in these Terms and Conditions; or

(f) otherwise breaches these Terms and Conditions.

The Promoter may request reasonable documentation to verify an entrant's eligibility.

23. Redraw

If the person drawn as the Winner is subsequently found to be ineligible, cannot provide the required verification, has breached these Terms and Conditions or otherwise forfeits their entitlement to the Prize in accordance with applicable law, the Promoter may conduct a redraw, subject to applicable State and Territory legislation.

 

 

Prize Availability

24. Prize Substitution

If the Prize or any component of the Prize becomes unavailable for reasons beyond the Promoter's reasonable control, the Promoter may substitute the unavailable Prize or component with a prize or component of equal or greater value, subject to applicable State and Territory legislation and any required regulatory approval.

Cash will not be offered as a substitute unless required or permitted by law.

25. Acceptance and Use of Prize

It is a condition of accepting the Prize that the Winner complies with any reasonable conditions of use, safety requirements, registration requirements and manufacturer's or Prize Supplier's requirements applying to the Prize.

No compensation will be payable if the Winner is unable to accept or use the Prize as stated, except where otherwise required by law.

 

 

Privacy

26. Collection and Use of Personal Information

The Promoter and its related entities collect and use Eligible Members' personal information for the purpose of administering and promoting the Promotion, including:

  • verifying eligibility;

  • administering entries;

  • conducting the Prize draw;

  • contacting and verifying the Winner;

  • announcing the Winner; and

  • arranging fulfilment and handover of the Prize.

The Promoter may disclose personal information where reasonably necessary to:

  • an independent draw scrutineer or agent;

  • the Prize Supplier or prize fulfilment provider;

  • professional advisers and service providers assisting with the Promotion; and

  • Australian Commonwealth, State or Territory regulatory authorities where required by law.

The Promoter will otherwise handle personal information in accordance with its Privacy Policy available on the Fishing Addiction website.

27. Prize Supplier

The Promoter may provide the Prize Supplier with the Winner's personal information where reasonably necessary to arrange the supply, registration, collection, delivery or handover of the Prize.

Personal information will not be provided to the Prize Supplier for unrelated purposes without the person's consent, except where otherwise permitted or required by law.

 

 

Winner Publicity

28. Promotional Activities

By accepting the Prize, the Winner agrees, where reasonably requested, to participate in reasonable promotional and editorial activities relating to the Promotion, including being photographed, filmed or interviewed.

Subject to applicable law, the Winner grants the Promoter a perpetual, non-exclusive and royalty-free licence to use photographs, video footage and other promotional material created in connection with the Promotion across the Promoter's media channels, including websites, social media, television, digital media and promotional material.

The Winner will not be entitled to any additional fee for reasonable use of such promotional material.

 

 

General Conditions

29. Promoter's Decisions

The Promoter's decisions regarding the administration of the Promotion are final, subject always to applicable Commonwealth, State and Territory legislation and any rights that cannot lawfully be excluded.

30. Events Beyond the Promoter's Control

Subject to applicable law and any required regulatory approval, the Promoter reserves the right to modify, suspend, postpone or cancel the Promotion if circumstances beyond its reasonable control prevent the Promotion from being conducted fairly or as intended.

Such circumstances may include technical failures, fraud, tampering, unauthorised intervention, natural disasters or other events that affect the administration, security, fairness, integrity or proper conduct of the Promotion.

31. Technical Issues

The Promoter accepts no responsibility for late, lost, incomplete, corrupted or misdirected membership information or entries resulting from circumstances beyond its reasonable control.

Any costs associated with accessing the Fishing Addiction website or maintaining internet or telecommunications services are the responsibility of the entrant.

32. Tax

The Winner is advised that tax implications may arise from accepting or using the Prize.

The Winner should seek independent financial or taxation advice regarding their individual circumstances.

 

 

Australian Consumer Law and Liability

33. Non-Excludable Rights

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including applicable rights under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law and applicable State and Territory consumer protection legislation ("Non-Excludable Rights").

34. Liability

Except for liability arising from Non-Excludable Rights or any other liability that cannot lawfully be excluded, the Promoter, its officers, employees, agents, related entities and the Prize Supplier will not be responsible for loss, damage, expense or injury arising from circumstances beyond their reasonable control in connection with:

(a) technical difficulties or equipment malfunction;

(b) theft, unauthorised access or third-party interference;

(c) an entry or Prize claim that is late, lost, altered, damaged or misdirected for reasons beyond the Promoter's reasonable control;

(d) any variation in the value of the Prize;

(e) any tax liability incurred by an entrant or the Winner; or

(f) the Winner's possession, operation or use of the Prize.

Nothing in this clause is intended to exclude or limit liability to the extent that doing so would be unlawful.

 

 

Compliance

35. Applicable Laws

The Promotion will be conducted subject to all applicable Commonwealth, State and Territory laws and any conditions imposed under an applicable trade promotion authority, permit or licence.

Where a provision of these Terms and Conditions conflicts with a mandatory legal or regulatory requirement, that requirement will prevail to the extent of the inconsistency.
